Hey sorry I have a question on if you are covered by workman's comp if you have been fired from a company. I am not sure if that makes sense just a question. The original thread Joke or attempt on life...is where it all got started. Later I will do an update on where I stand with former employer. After I was denied unemployment, I flied for an appeal and my statement hit pubic record and now every atty under the wood works is coming out offering their services.

I also filed complaints last week with the EEOC and they are going to follow up with me on my options and what I should do. I don't know where or what posting it is but I remember mentioning how odd my ex boss was acting when he freaked out and would take the radio's away at work if the channel was changed, or him hiding tools and other stuff just to have you look for it. Now that I have been thinking back on everything that happened I am seeing a pattern in his madness. On the other hand he could had been just being a prick or jerk. All I do know is everything started down a downhill slide after I got on insurance and all the ADD came out. 4 months is pretty quick.

Since everything hit the point of pubic record I am sure they were sent a copy of my statement to former employer and they know the facts again after I have already told them before, but now its official now. Since the wrong doing is completely laid out for them its easy to see their wrong doing. I am thinking abut sending them a request for a certain amount of money to settle all this up now. I am going to do one of 3 things. Pursue an lawsuit against them for wrongful termination, failure to properly follow up from their MRO on key medical information clearing me, criminal assault charges against ex boss, and holding the parent company liable for the actions of their sub corp. Or send them a letter expressing their wrong doing and demanding an out of court settlement since that would be in their best interest keeping this quiet and no bad press on them for their vagrant wrong doings and improper follow through. Or I may just be nice and tell them I want my job back with past pay with raise and cash amount.

Ok gees sorry I ended up giving an update anyway. So what would you think best option to do would be? They really messed up and know it. I just wonder what its worth to them to just make all this "go away". If the EEOC finds wrong doing on the ADA, Iwill definitely let them file a suite against them for that vagrant violation of the law to protect the rest of us out there from being ADD'ed out of a job again.

Just curious....what would other ADD'ers do? Let me know on the workman's comp thing too. My original question. Sorry.

Thanks,
Zeb

I believe if you were injured on the job, the relevant point would be would be the date of the injury and whether you were employed at that time. Your subsequent employment would not be relevant.

Naw I was not injured on the job, its more of the political fallout. I was very stressed from the whole thing at work and after I was fired it was even worse. If not for what they did, I would not had stress to deal with in the first place. I just am having negative side effects from all the prolonged stress and anxiety and didnt know if that would be covered under workmans comp. I just dont know if stress is a injury all I know is it sucks bad,

Thanks,
Zeb

I can't speak for all states' workers comp laws, but generally you don't get anything for "pain and suffering". Compensation for disability or loss of income due to an injury or illness caused by work (like coal miner's black lung, I guess).

Yea thats what I thought. Its just a big mess. Its not like I was hurt just stressed severely when all this broke loose and not being able to get it undercontrol with the fallout I never started just got caught up in.

Wish for once I could be in the right place at the right time.;) Guess I should just be patient and let them do what they are doing.

Thanks,
Zeb
