Any legal protection from losing job because of symptoms?

I seem to remember reading somewhere that there are some protections from losing a job because of valid struggles with things like ADHD and OCD. Is this true? My husband is seeing a psychologist regularly to work on his issues related to his diagnosed (and newly medicated) ADHD and OCD, however he is very close to losing his job because of the combined symptoms. He works at Wal-Mart (for the past 9-1/2 years). Is there anything we can do, like have his medical doctor and psychologist write letters verifying the validity of his symptoms and that he's medicated and working on it??

My understanding is that you start with human resources and get the ball rolling then if everyone is made aware that you have a disablity (not just adhd that canbe private) they are supposed to make accomodations and if they dont then they are violating the ADA. I could be wron though.

The Americans with Disabilities Act provides some protection for people with disabilities on the job.

Your husband would be protected under ADA if he is qualified for the job (which I'll assume he is, if he was hired and they kept him on for 9 years), and if he can perform the major duties ("essential functions") of his job with or without reasonable accommodations.

Your husband would have to disclose the disability to the employer to be eligible for accommodations and protection under ADA, though. He can't wait until he gets fired and then bring it up.

You might be interested in looking up the Job Accommodation Network, which is a nonprofit organization that deals with disability and employment issues. It has a fairly in-depth website with info about the ADA, disclosing disabilities in the workplace, etc. It also has many real-life scenarios and accommodation suggestions for various types of disabilities in various types of settings.

Yeh legal prostitution is allowed in many states and countries but I don't think the profession protects you from losing your regular job becuase of adhd. I applaud you for your courage to take on a new profession.

Some additional information on federal laws concerning reasonable accommodations for disability can be found here: http://www.eeoc.gov/laws/types/disability.cfm

Some state and local governments have similar laws which may provide greater protection than the ADA.

Oh no, I'm not talking about legal "prostitution". You'll have to reread what I wrote. I don't want to leave you thinking I'm a prostitute. Gotta nip that rumour in the bud before it takes off!
